This User Agreement (hereinafter referred to as the "Agreement") governs the relationship between Sole Proprietor Yarovenko Maksym Oleksandrovych (hereinafter referred to as the "Seller") and the user of the website tomato-king.com (hereinafter referred to as the "Buyer") when purchasing tomato seeds and other goods through the online store.

By using the website tomato-king.com, you confirm your acceptance of the terms of this Agreement. If you do not agree with the terms, please do not use the website.

1. General Provisions
1.1. The Seller carries out retail sales of seeds via the website tomato-king.com.
1.2. This Agreement is a public offer in accordance with the legislation of Ukraine.
1.3. The Seller may change the Agreement without prior notice. The current version is always available on the website.

2. Registration and Order Placement
2.1. To place an order, it is necessary to provide accurate contact information.
2.2. The Seller is not responsible for any consequences arising from errors in the information provided by the Buyer.
2.3. Placing an order constitutes the Buyer's agreement to purchase the goods under the terms of this Agreement.

3. Payment
3.1. Payment is accepted via:

  • Online bank card (Visa / MasterCard),

  • Google Pay,

  • Apple Pay,

  • Monobank (MonoPay),

  • PayPal,

  • Western Union.
    3.2. Payment may be made in the following currencies: Ukrainian Hryvnia (UAH), US Dollar (USD), Euro (EUR), Polish Zloty (PLN), depending on the payment method and buyer's region.
    3.3. Current prices and exchange rates are displayed at the time of ordering.

4. Delivery
4.1. Delivery is carried out within Ukraine and internationally via postal services.
4.2. Delivery cost and terms depend on the postal operator (Ukrposhta, Nova Poshta, etc.) and region.
4.3. The Seller is not responsible for delays, damage, or loss caused by postal services or customs in the recipient’s country.
4.4. Reshipping in case of return due to the Buyer's fault (non-collection, refusal to accept) is at the Buyer’s expense.

5. Returns, Variety Mismatch, Warranty
5.1. The Seller guarantees the conformity of seed varieties to their descriptions and high seed quality.
5.2. Variety Mismatch (Off-type): Occasionally, you may receive seeds of a different variety than ordered. If this occurs, please inform us and indicate:

  • The variety you ordered and the one you received;

  • Approximate purchase date (month and year);

  • Nature of the discrepancy.

Note: If the difference is due to the variety's instability or natural segregation (especially with rare or exotic varieties like blue or striped types), the Seller cannot be held responsible. This is a natural result of breeding.

5.3. Return or Replacement is possible if an error on the Seller's part is confirmed. We will offer:

  • A replacement,

  • Or a refund for the specific variety.

Claims must be submitted within 6 months from the date of purchase.

5.4. Return of quality seeds is not accepted according to Ukrainian law (seeds are a non-returnable item if the Buyer changes their mind).

6. Liability
6.1. The Seller is not responsible for harvest results, as they depend on many factors: climate, soil, techniques, timing, etc.
6.2. All variety descriptions are based on producer data and personal experience but are not a guarantee of outcome.
6.3. Natural trait segregation may occur in some unstable or exotic varieties — this is a normal part of plant breeding.

7. Personal Data
7.1. By placing an order, the Buyer consents to the processing of personal data in accordance with Ukrainian law.
7.2. The Seller does not transfer personal data to third parties, except where required by law.

8. Final Provisions
8.1. All materials on tomato-king.com are intellectual property. Copying or use without permission is prohibited.
8.2. Disputes shall be resolved through negotiation or, if necessary, in accordance with the legislation of Ukraine.
